Celsius Earn-account ownership ruling: what the court decided

Archive note: The original December 2022 article previewed a pending decision. This version records the court's 4 January 2023 ruling.

The US Bankruptcy Court for the Southern District of New York ruled on ownership of assets in Celsius Earn accounts. The court relied on the applicable terms of use, including a transfer-of-title clause, in deciding that the assets became property of the bankruptcy estate.

The decision was case-specific. It should not be generalised to every exchange, wallet or interest-bearing account: ownership and customer claims depend on contract terms, custody structure, jurisdiction and insolvency law.
